The guest acknowledges and agrees that his/her use of the premises constitutes only a license to use and is not any form of tenancy recognized under Chapter 83, Florida Statutes.  Guest’s use is a “transient tenancy” as defined under Chapter 509, Florida Statutes and any failure to pay any amount due for use of the premises shall entitle “The Company” to those remedies set forth in Section 509.401.  Florida Statutes, as well as all other remedies available under Florida Law.                             

Limitation of Liability – Premises and Pools                                                                              

“The Company” is acting solely as an agent for the owners of vacation properties.  Any unsafe condition or failure of services must be immediately reported by the guest to the local management who will endeavor, within reason, to rectify the problem.  “The Company” is not liable for any condition or failure of services in the vacation property.  Guest will diligently supervise all children especially when using pool facilities.  Pool alarms are installed on all pool area access points, (doors and windows).  The guests’ deactivation of said alarm shall constitute an absolute exculpation of “The Company” and property owner of any liability resulting from personal injury or property damage.  “The Company” / property owners do not accept any responsibility or liability for any failure of services in the home regardless of how it may have occurred.

All information regarding the properties is checked to ensure accuracy of descriptions.  However, we are not always able to control all of the components of the facility and it is possible that an advertised facility may be withdrawn or changed due to circumstances beyond our control and for which we do not accept liability.
